These terms govern access to and use of WorkHorse Enterprise freelance marketplace services.
1. Acceptance of Terms
By accessing or using WorkHorse Enterprise, you agree to be bound by these Terms & Conditions, our Privacy Statement, payment policies, escrow policies, and any additional guidelines published on the platform.
2. Platform Role
WorkHorse Enterprise provides a marketplace where employers may post jobs and freelancers may offer services. Unless specifically stated, WorkHorse is not a party to the service contract between an employer and a freelancer.
3. User Accounts
- You must provide accurate registration information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree not to create fraudulent, misleading, duplicate, or unauthorized accounts.
- WorkHorse may suspend or terminate accounts that violate platform rules.
4. Employer Responsibilities
Employers are responsible for posting accurate job descriptions, funding escrow when required, communicating professionally, reviewing submitted work promptly, and releasing payment when work is completed according to the agreed terms.
5. Freelancer Responsibilities
Freelancers are responsible for providing truthful profile information, submitting original work, meeting agreed deadlines, maintaining professional communication, and complying with applicable laws and platform standards.
6. Payments, Wallet, and Escrow
- Funds deposited into a wallet may be used for platform transactions.
- Escrow funds may be held until work milestones are completed or disputes are resolved.
- Payment processing may involve third-party providers such as Stripe, PayPal, M-Pesa, or manual processing.
- Provider fees, platform fees, chargebacks, reversals, and refunds may affect final balances.
7. Refunds and Disputes
Refunds may be reviewed according to payment status, project status, escrow status, evidence provided, and platform policy. WorkHorse may review communications, files, milestones, and transaction records to resolve disputes.
8. Prohibited Conduct
- Fraud, scams, misrepresentation, or identity abuse.
- Attempting to bypass WorkHorse payment or escrow systems.
- Uploading malicious files, illegal content, or infringing materials.
- Harassment, discrimination, threats, or abusive communication.
- Unauthorized access, scraping, reverse engineering, or platform disruption.
9. File Uploads and Content
Users retain ownership of their submitted content but grant WorkHorse a limited license to store, display, process, transmit, and use such content as necessary to operate the marketplace and related services.
10. Reviews and Ratings
Reviews must be honest, professional, and based on actual marketplace interactions. WorkHorse may remove reviews that are fraudulent, abusive, irrelevant, or violate platform policy.
11. Privacy
Use of WorkHorse is also governed by our Privacy Statement. By using the platform, you consent to collection and processing of account, transaction, communication, and usage information as needed to operate the service.
12. Service Availability
WorkHorse aims to provide reliable service but does not guarantee uninterrupted, error-free, or permanently available access. Maintenance, outages, third-party failures, or security events may affect availability.
13. Limitation of Liability
To the fullest extent allowed by law, WorkHorse is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from platform use, marketplace interactions, payment delays, third-party provider issues, or user disputes.
14. Indemnification
You agree to defend, indemnify, and hold harmless WorkHorse, its owners, employees, contractors, and affiliates from claims, damages, losses, liabilities, and expenses arising from your use of the platform or violation of these terms.
15. Changes to Terms
WorkHorse may update these terms from time to time. Continued use of the platform after changes are posted means you accept the updated terms.
